DOJ Urged To Investigate New York Gun Laws

Thank you Congresswoman Claudia Tenney, R-24 of Cleveland, Oswego County, and Congresswoman Elise Stefanik, R-21 of Schuylerville, Saratoga County who have called for the Department of Justice to investigate what they say is “New York State’s infringement of New Yorker’s Second Amendment rights” through its gun regulations. New York State’s infringement of New Yorker’s Second Amendment rights needs to finally be challenged, it is one of the Bill of Rights and a Constitutional guarantee.

The Supreme Court struck down New York state’s system for issuing concealed weapons permits, ruling that the restrictive law requiring that applicants demonstrate “proper cause” violates the Second Amendment. In writing the 6-3 majority opinion, Justice Clarence Thomas wrote, “Because the State of New York issues public-carry licenses only when an applicant demonstrates a special need for self-defense, we conclude that the State’s licensing regime violates the Constitution.” The CCIA (Concealed Carry Improvement Act) should at least be put on hold, while the DOJ is investigating infringement of New Yorker’s Second Amendment rights .


In a letter to U.S. Attorney General Pam Bondi, Tenney emphasized the Department of Justice’s responsibility to uphold constitutional rights. She called for a swift federal investigation into New York’s gun control framework. “The Second Amendment is not a suggestion,” she said. “It is a Constitutional guarantee that requires enforcement.” According to Tenney, DOJ intervention is necessary because New York lawmakers have, in her words, “restricted the rights of New Yorkers for too long.”
